Course overview

One essential area for any people manager is to have a good knowledge of what the law requires so the Managing People Lawfully and Effectively workshop is a programme every line manager should attend.

The purpose of this workshop is not only to educate people managers on how to manage staff issues lawfully but to give the skills needed to do so in practice.

Welcome and introduction

  • Why are we here?
    • A brief review of key objectives and outcomes from the organisation and the delegates’ perspective.

Session 1: Legal and practical issues in recruitment and selection

  • Legal issues concerning pre-employment
  • Contract essentials and employee status
  • Express and implied obligations arising from the contract of employment including:
    • Obedience
    • Competence, flexibility and co-operation
    • Safety
  • Discrimination avoidance, PIDA, effective interviewing skills etc.

Focus on getting the right people (right for the work and for the organisation) first time every time.

Session 2: Employee rights and equal treatment 

  • The Equality Act 2010 and the various types and forms of discrimination protected therein
  • Ensuring an environment free of bullying, discrimination and harassment
  • Working Time Regulations
  • Health and Safety issues (if relevant and required)

Using examples, we will explain what is and is not acceptable behaviour such as banter, socialising, joke telling etc. We will look at the various forms harassment may take i.e. non-verbal, text, emails, PC issues, labelling, social networking sites, physical and verbal.

Session 3: Lawfully managing employee performance and discipline

Issues requiring active management within the law during the course of employment such as:

  • Disciplinary
  • Poor performance
  • Absences
  • Grievances

We will review key processes and look at what lawful management means in practice including a review of the essential conversations and letters/documentation.

Session 4: Family friendly legislation and what the law requires

  • Maternity
  • Paternity
  • Parental leave
  • Shared parental leave
  • Flexible working, and so on

We will look at what the law requires and then what terms/processes are provided by the organisation.

Session 5: Lawful termination of employment

  • The five potentially fair reasons to dismiss and constructive dismissal
  • What the legislation and case law requires in order to demonstrate fair dismissal (substantive and procedural)
  • How the Employment Tribunal works
  • Vicarious liability

We will review key processes when it comes to employees leaving the organisation and look at what lawful management means in practice including a review of the essential conversations and letters/documentation.

Session 6: The key areas of management responsibility

  • How to be the right role model, living the values, behaving reasonably etc.
  • Informal v formal management.
  • The importance of note keeping, positive active management and following up where required.

Toni Trevett

Toni Trevett is a director of CompleteHR Ltd, an HR consultant, and a coach, mediator and trainer specialising in HR/people management skills, employment law, management development and personal development. She has experience of working with a variety of large and small organisations and has considerable experience of work in both the public and private sector. Clients include British American Tobacco, Schlumberger, Stihl, Shell, The Telegraph, Dairy Crest, Bywaters, NATS the ACCA, AAT and many more.

She was formerly a human resources director within the BAA plc group. She is a fellow of the Chartered Institute of Personnel and Development and a member with over 20 years standing of the Employment Tribunal judiciary, hearing cases in London and the South East. In addition to her training work she conducts investigations and hearings for clients on disciplinary, grievance, discrimination, harassment and bullying issues and is also a workplace mediator.
