Clive Thorne

Clive’s practice encompasses all areas of intellectual property; including patents, copyright, trademarks, passing off, breaches of confidence, privacy and data law. He has wide international experience, particularly in the Far East, and is admitted to practice in Hong Kong and Australia. He has handled disputes in all relevant courts including the High Court, IPEC, Court of Appeal, Privy Council and UK Supreme Court. Clive is a firm believer in the value of arbitration for determining IP disputes and has been appointed to sit as an arbitrator by inter alia, ICC, WIPO and in specialist panels. He has written and lectured widely on IP law and recently published the latest edition of “Users Guide to Copyright.”

Clive trained at Clifford-Turner and later practised in the UK and Hong Kong with Baker-Mckenzie. For many years he headed the IP practice at Denton Hall and subsequently at Arnold and Porter.  More recently he was a partner at RPC and Wedlake Bell and Special Counsel at Baker -Botts.

He has acted for clients in many industrial fields including; IT, aerospace, retail, pharmaceutical and healthcare, toys and games, publishing, food, press, advertising and air-conditioning. He has also handled many leading IP actions.

Recent work has included acting for the successful party in the Court of Appeal in a patent action relating to wound dressing technology, handling a multi-jurisdictional copyright and trade mark dispute for a Hong Kong food manufacturer, acting for an intervening party in the UK Supreme Court in the constitutionally important Article 50 judicial review, handling a design protection campaign for a New Zealand manufacturer of distinctive kitchenware and defending patent attorneys in professional negligence claims.
